1. Agreement to Terms
By accessing or using the StorySparkle website and related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not access or use the Service.
2. Eligibility
You must be at least 18 years old and have full legal capacity to enter into binding contracts in the United Kingdom. Parents or legal guardians may create and manage accounts on behalf of children under 13. Children aged 13–17 may use the Service only with parental consent and under supervision.
3. Your Account
- Registration: To use certain features, you must register an account using a valid email address, Google Sign‑In, or Facebook Login. You agree to provide accurate information and keep it up to date.
- Credentials: You are responsible for safeguarding your account credentials. Notify us immediately if you suspect any unauthorised use of your account.
- Account Deletion: You may delete your account at any time by contacting support@storysparkle.org. Upon deletion, we will permanently erase your personal data within 30 days, per our Privacy Policy.
4. Parental Guidance & Children's Use
StorySparkle is designed for children aged 3–12 to develop reading and literacy skills (including dyslexia support). We strongly recommend that parents or guardians:
- Create and manage all child accounts.
- Supervise their child's use of the Service.
- Review content and privacy settings on the child's behalf.
5. Acceptable Use
You agree not to:
- Use the Service in any way that violates UK law, infringes others' rights, or exposes us to liability.
- Attempt to access other users' accounts or personal information.
- Transmit viruses, malware, or other harmful code.
- Interfere with the Service's security, performance, or integrity.
- Use automated means (bots, scrapers) to access or collect data from the Service.
6. Intellectual Property
- Our Content: All text, graphics, logos, audio, video, code, and other content on the Service ("Our Content") are owned or licensed by StorySparkle and protected by UK and international copyright and trademark laws.
- Your Submissions: If you submit any feedback, ideas, or content to us, you grant StorySparkle an irrevocable, perpetual, royalty‑free, worldwide licence to use, modify, and distribute that submission for any purpose.
7. Third‑Party Services
We integrate with third‑party services to deliver and improve our Service, including:
- Google Analytics 4 and Microsoft Clarity (aggregate analytics)
- Google and Facebook for authentication
- Stripe payment gateway for processing any payments (or other payment gateway services as applicable)
Your use of those services is subject to their own terms and privacy policies.
8. Disclaimers
- "As Is" Basis: The Service is provided "as is" and "as available." We make no warranties—express or implied—regarding reliability, accuracy, or fitness for a particular purpose.
- No Professional Advice: Content is for general literacy support and is not a substitute for professional educational or medical advice.
9. Limitation of Liability
To the maximum extent permitted by law, StorySparkle and its officers, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability under or relating to these Terms shall not exceed £100.
10. Indemnification
You agree to indemnify and hold harmless StorySparkle and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your breach of these Terms or unlawful use of the Service.
11. Governing Law & Jurisdiction
These Terms and any dispute arising from them are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
We may revise these Terms at any time. The "Last updated" date at the top will reflect the date of the latest revision. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Severability
If any provision of these Terms is held invalid or unenforceable, that provision shall be struck out, and the remaining Terms will continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and StorySparkle regarding your use of the Service and supersede all prior agreements.
15. Language Precedence
In the event of any inconsistency between the English language version of this policy document and any other language translations, the English language version shall take precedence.
